Temporary Restraining Order by a Federal Court Dissolved

We conducted an emergency hearing in federal court after a judge froze our clients assets – worldwide. An insurance company had obtained the restraining order behind closed doors, without our involvement. The order was issued in a case brought against our client by a group of nationally known insurance companies who alleged fraud and racketeering, which we vigorously defended, contending that is was a lawsuit without any basis.

We immediately demanded a hearing for, the next day, and the court granted the application and also required the insurance company to have witnesses ready to testify. The judge indicated that she did not believe that we could establish a basis for the court to dissolve the restraining order, without a full blown evidentiary hearing. Mr. Quadrino engaged in an extensive two hour oral argument urging the judge to dissolve the order and that a hearing with evidence was not required.
