Insurance Obtained for a National Restaurant Chain
Our client, a chain of regional steak restaurants, was embroiled in a lawsuit over its business practices and methods. A national competing restaurant chain sued for unfair competition. The insurance company for our client was alleging that there was no coverage for the lawsuit.
We analyzed the “advertising injury” section of the insurance policy, conducted legal research, and had a high-level meeting with senior staff of the insurer and its counsel. We persuaded the insurer and its lawyers that the section of the policy we referenced indeed provided coverage for the lawsuit. The insurance company agreed to pay for the legal fees incurred in the lawsuit as well as any funding for a settlement or verdict, if necessary.
