We were hired to defend a client in a federal insurance fraud lawsuit brought against the client by a national insurer. The insurer attempted to use a state law that would allow it to recoup not only the amounts it paid, but attorney’s fees and the costs of its investigation.
After a complete investigation, we marshaled all of the legal tools available and scheduled a mediation with a former federal judge and both inside and outside counsel for the insurer. We vigorously argued that not only did the client not commit fraud and did not owe anything to the insurer, but argued that the insurer actually owed additional funds to our client.
After an extensive mediation and conference with all parties and counsel, we were able to not only persuade the insurer to drop its lawsuit against our client completely, but also to pay the additional funds to our client — a complete reversal of what the insurer intended when it sued our client.
